Celem niniejszego artykułu jest odpowiedź na pytanie, czy na podstawie obowiązujących przepisów prawa lekarz/lekarz dentysta, który ukończył staż podyplomowy, ma prawo skorzystać z preferencyjnej podstawy wymiaru składek na ubezpieczenia społeczne i Fundusz Pracy, stanowiącej 30% minimalnego miesięcznego wynagrodzenia, jeśli w ramach prowadzonej działalności podjął współpracę z podmiotem, u którego był zatrudniony w ramach realizacji stażu podyplomowego. Aby dokonać prawidłowego omówienia przedmiotowego zagadnienia, autor przeprowadził analizę orzecznictwa, doktryny, a także przepisów ustaw: z 13 października 1998 r. o systemie ubezpieczeń społecznych, z 5 grudnia 1996 r. o zawodach lekarza i lekarza dentysty oraz ustawy z 26 czerwca 1974 r. – Kodeks pracy. Rozważania doprowadziły autora do wniosku, iż na gruncie omówionego stanu faktycznego sprawy lekarzowi/lekarzowi dentyście przysługuje prawo do preferencyjnych składek ZUS.

Abstract:
The purpose of this article is to answer the question whether, pursuant to applicable law that relates to a doctor/dentist who has completed a postgraduate internship has the right to use the preferential basis for calculating social insurance and Labour Fund contributions, constituting 30% of the minimum monthly remuneration, if the doctor/dentist has already started cooperation with the entity in which the doctor/dentist was employed as part of the postgraduate internship. In order to properly discuss the issue, the author has analyzed the jurisprudence, doctrine, and the regulations from the following Acts: on the social insurance system (of October 13, 1998), on the professions of doctor and dentist (of December 5, 1996) and the Labor Code (June 26, 1974). The considerations led the author to the conclusion that the doctor/dentist, on the basis of the discussed facts of the case, is entitled to pay preferential ZUS contributions.
